Terms & Conditions

Overview

These Terms of Use (Terms) govern your use of our site and our commitment to you. In a general sense these terms make clear that myonlinerep is a free service, that we only collect information and data that is either provided by you voluntarily or is publicly available online, that our scores represent only our view of your reputation and we are not responsible for how you or third parties use the score, and that all scores, algorithms and other content and processes are the intellectual property and / or copyright of myonlinerep.

General principles

  • Your agreement is with MYONLINEREP PTY LTD. The company is registered in New South Wales, Australia (ACN. 607 896 864)
  • The myonlinerep score and any other products and services represent just one opinion on an individual’s reputation
  • All parties using this site and associated products and services agree that they will make their own judgement about the quality of any individuals’ online reputation and that the myonlinerep score, products and services are just one input into forming that judgment
  • All parties agree to take full responsibility for any decisions they make about an individual’s reputation regardless of whether they have included myonlinerep scores, product and services in their decision-making process. All parties also agree that the information will not be used to engage in unfair or deceptive practices
  • All parties understand and accept that the myonlinerep score is simply a statement of the opinion of myonlinerep at the date of writing and does not constitute a recommendation to enter into, or not enter into, an agreement with any person or entity
  • All parties acknowledge that a score produced by myonlinerep is relevant only at the time at which it is produced and that scores may change as a result of new or previously unidentified activity of the individual online. myonlinerep does not warrant or guarantee the timeliness, currentness, accuracy, completeness, merchantability or fitness for a particular purpose of the information.

Your use

  1. You agree that your use of the myonlinerep site is voluntary and all information provided to us by you has been done so freely and willingly.
  2. You accept that any other information used by myonlinerep to develop your reputation score is publicly available and could be found by anyone.
  3. You accept that we may store some or all of the publicly available data we collect about your to help further develop our processes, algorithms and scores
  4. You agree that all outputs are the intellectual property and / or copyright of myonlinerep and may not be reproduced without our express written consent. You further acknowledge that you may be liable for such unauthorised use, including financially liable.
  5. You agree to indemnify myonlinerep, its Directors, employees and any agents against any loss whatsoever arising from the myonlinerep score. You also acknowledge that we make no warranty in relation to goods or services supplied by us or your use of the site. Furthermore, we exclude all liability to you (including liability relating to consequential or indirect loss), except to the extent permitted by law. Subject to the remainder of this clause our liability to you will otherwise be limited to the amount paid by you (if any) to us in relation to goods and services acquired on the site.
  6. You accept that myonlinerep is currently a Beta product / service and will undergo ongoing improvements to provide a consistently improved service.
  7. You agree that the information provided to myonlinerep by you may be used to provide you with updates on our product / service and to promote new products / services to you.
  8. You acknowledge that the operations of myonlinerep are based in Australia and New Zealand and your data will be used in both jurisdictions between myonlinerep Directors, employees and agents.

Monthly monitoring service
This section is applicable to those individuals who subscribe to the monthly online reputation monitoring service.

 

  1. The myonlinerep monitoring service is a fee based service with payments processed through the PayPal payment gateway.
  2. Your utilisation of the monitoring service is voluntary and solely at your own discretion.
  3. The monitoring service will provide alerts and updates on changes to your online reputation with a minimum of one refreshed report each calendar month.
  4. The monitoring service is a fee based service charged at AUD$4.99 per month. The first charge will be processed at the time of registration for the monitoring service at which point you will be asked to provide relevant credit card details through the PayPal payment gateway. After the initial charge the service will be billed on a rolling monthly basis.
  5. myonlinerep does not access your credit card details and the payment process is a relationship between yourself and PayPal, which collects the monitoring service fee on behalf of MYONLINEREP PTY LTD.
  6. You may cancel your monitoring service at any time by emailing clientservices@myonlinerep.com.au with the subject line ‘Cancel monitoring service’. Cancellations are processed at the end of each calendar month.
  7. All other Terms and Conditions detailed in the sections ‘Your use’ and ‘Our responsibilities’ remain in effect.

Our responsibilities

  1. We will not sell or share your data with any third parties and we will take all reasonable care to protect your information and comply with all relevant privacy laws.
  2. We will notify you if we deem there to have been any consequential data breaches or if the law otherwise requires us to.
  3. We will respond to any complaints or inquiries within a reasonable timeframe and will make all reasonable endeavours to provide you with the most up to date and accurate answers to your questions.
  4. We will comply with all relevant laws and regulations and will engage in good faith with any government body or regulator that wishes to discuss our service / product.
